Terms of Service.
The rules of engagement. Clear, transparent terms governing the use of the GetMax platform, automation tools, and API services.
Please read these Terms of Service ("Terms") carefully before using the GetMax Healthcare Solutions website or the GetMax AI-native revenue cycle management platform (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
1. Platform Access and Usage
GetMax grants you a limited, non-exclusive, non-transferable, and revocable license to use our Services strictly for your organization's internal business operations. You agree not to:
- Reverse engineer, decompile, or disassemble any part of the Services or its underlying AI models.
- Use the Services to develop a competing product or service.
- Attempt to bypass or break any security mechanism on the platform.
- Use the platform for any illegal or unauthorized purpose.
2. HIPAA and Business Associate Agreement (BAA)
To the extent that you transmit Protected Health Information (PHI) to GetMax, you acknowledge that a separate Business Associate Agreement (BAA) must be executed prior to such transmission. You are responsible for ensuring that you have the necessary consents, authorizations, and legal bases to share patient data with our systems.
3. AI Disclaimer & 'Human in the Loop'
GetMax utilizes artificial intelligence to automate medical coding, verify eligibility, and predict claim denials. While our systems are trained for high accuracy:
- AI models are probabilistic and may generate errors, false positives, or incomplete outputs.
- GetMax is an administrative tool, not a substitute for professional medical judgment, licensed clinical oversight, or certified final review.
- You agree that your organization maintains ultimate responsibility for the accuracy of claims submitted to payers, and that flagged or ambiguous AI outputs require a human-in-the-loop review.
4. Intellectual Property
Your Data: You retain all ownership rights to the data, documents, and PHI you upload to the Services.
Our Technology: GetMax retains all right, title, and interest in and to the Services, including our software, algorithms, machine learning models, UI/UX designs, and any aggregated, de-identified telemetry data used to improve the platform.
5. Limitation of Liability
To the maximum extent permitted by law, GetMax Healthcare Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to, or use of, or inability to use the Services.
6. Termination
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms or the associated BAA. Upon termination, your right to use the Services will immediately cease.
